Terms and conditions
Operation Field
Terms and conditions apply in an exclusive way to current and future commercial relations ships existing between Brod’Innov (Paddock-sports.com) and its clients
Pictures representing our products are not contractual. Any modification of those terms are possible but are not retroactive.
Prices and orders
Every price on our website are Tax included, and apply while placing the order.
Prices can change any time and to our only initiative. They can go through variations depending on exceptional events which are not under our will. In this case, we would be forced to apply the prices resulting from those changes.
By confirming your order, you accept the integrality of the terms and conditions at your disposal on the website, and acknowledge knowing it perfectly, giving up the fact to use any contradictory document, including our own terms and conditions. This confirmation and the totality of the data we will have recorded will be the proof or our exchanges.
Payment
Payment is due on the order date. You have several payment systems providing the maximum level of security:
· Credit Card (CB, Visa, Eurocard Mastercard ) : Secured payment system by CM-CIC.
- Paypal
The online secured credit card process uses the SSL protocol and has all the necessary safety aspects: the information transmitted are encrypted and never circulate visibly on the network. We are using for our transactions le CM-CIC payment system, our partner. Our order’s process can only happen when your payment has been accepted and this acceptation has been sent to our services by CIC.
Your banking information (credit card number, expiration date, etc.) never transition on our website.
Shipping costs
- For an order under 99 € Tax Incl. : 8€
- For an order over or 99€ : free shipping costs.
Delivery
Our parcels are shipping between 2 or 3 days (France) via UPS.
Please get in touch with us for any other country.
The delivery is made to the address you sent us in your order. Shippings are done from Monday to Friay (except for Holidays).
From the date the items your order left our locations, the risks are at your own responsibility.
Delivery times are only given as an indication, except if, on an exceptional basis, we committed to respect a certain delivery date.
A confirmation email es sent when the parcel is on its way, after dropping it to the shipping company.
We can’t be held responsible for non-respected delivery time by the shipping company. The overtime for shipping can’t lead to damages and legal actions.
Returns and reimbursements
We guarantee the quality and good condition of every item we are shipping you. You have a withdrawal period of 7 days from the day our received the items. You must reach out to us to validate a return number which will be given to you and must be on the parcel. The sending back costs are on your expense.
Our products are always shipped under the buyer’s risk, whatever the shipping mode, or the delivery terms are.
The client has to check the order status at the delivery time by the shipping company, in case of damage or missing piece, to mention it on the delivery slip and to confirm under 48 hours with a recommended letter addressed to Brod’innov.
Reclamations which won’t be written in the three working days following the delivery date will be known as late, and won’t be taken care of.
Only the defective goods returned in its original condition, without being used and after being checked and agreed with us in our stores will be accounted for replacement. Any product used won’t be reimbursed.
Product availability
Product offers are applicable within the limits of available stocks.
Non available products are not deleted from our showcase unless the disruption is signaled as definitive with our suppliers (out of stock).
In case of one time out of stock condition on products which are still in stock at the supplier, shipping the order will be done in 2 steps: a first step with the available items and a second step after restocking, with any other shipping cost for the client.
Guarantee of the latent defects and responsibility
If the products we delivered had a latent defect, we could up to our own choice, take off this defect or replace the damaged item.
If we don’t want to eliminate this risk, or replace the damaged item, or if we can’t do it, or if we can’t do it in the given time because of elements not depending on our will or our cause, you will be able to either send it back against reimbursement of the item price and shipping costs, or ask for a reduction of the sales price.
Offered products compliant with the current French regulations. We are committing to use all the used cares to offer this service to our client.
Never the less, our responsibility could not be held in case of failure to our contractual obligations, because of an incidental case or force majeure case such as without any limitations, natural disasters, strikes, fires, equipment, shipping or communication failure dur to our doing.
Moreover, our we won’t be held responsible in case of delay due to out of stock condition, or in case of mistake in the products presentation on our website, photos, texts or pictures representing the products not being contractual.
Reservation of ownership
The delivered items will remain Brod’innov’s property until all of your obligations are fulfilled, until the complete payment, according to the law n° 90325 du 12 Mai 1980.
Personal data protection
The information asked is for most of them signaled such as, necessary to deal with and execute your order, or improve our services.
Your personal data treatment is done by respecting the livery and informatic law 06/01/1978. You have an access and modification right to your personal data. To do this you need to get in touch with us by email (contact@paddock-sports.com ).
Your details can be sent for a part of it to our partners or providers to insure best your order and delivery management. Their use is only limited to those actions.
Applicable law and competent court
The following terms and conditions are submitted to the French law. Any dispute related to the exisiting commercial relation ship between you and us are submitted to the exclusive authority of French juridictions.
Service and responsibility interruption
Brod’innov declines every responsibility : in case of interruption of the paddock-sports website for technical or data actualization maintenance. In case of a momentary impossibility to access paddock-sports.com because of technical issues, whether they are the origin or the cause of the content, access or use of paddock-sports.com
